Affirmative asylum in the United States is a process where individuals already present in the U.S. can proactively apply for asylum with U.S. Citizenship and Immigration Services (USCIS). Individuals seeking asylum in the United States must also file their asylum application within one year of their last entry. This one-year filing deadline is a crucial requirement for asylum eligibility. However, if an individual misses the one-year filing deadline, they may still be eligible to apply for asylum if they can demonstrate certain exceptional circumstances that prevented them from filing within the one-year timeframe. Our law firm is committed to guiding applicants from around the globe through the complex asylum application process.
Upon submission of the asylum application, USCIS arranges a biometrics appointment for you, during which your fingerprints, photographs, and signatures are collected for background checks. Following the submission of the affirmative asylum application (Form I-589) there is a waiting period of 150 days. After this period, we can assist you in filing Form I-765 with USCIS to request work authorization. Subsequently, USCIS schedules an interview with the asylum applicant to assess their eligibility. During the interview, our attorney, Mr. Boora, maybe be present to provide support. An asylum officer will inquire about your past and future persecution, your personal experiences, reasons for seeking asylum, and any supporting evidence. You will have the opportunity to present your case and provide additional information as necessary.
In the event of a USCIS denial and referral to immigration court for removal proceedings, Mr. Boora will vigorously defend your rights and pursue all available legal remedies. With that in mind, we understand the fears, uncertainties, and possible persecution if deportation occurs. We draw on our experience to provide compassionate and culturally sensitive representation,
tailoring our approach to meet the specific needs and concerns of each client. We offer
comprehensive legal support every step of the way.
