Affirmative Asylum Applications

Affirmative asylum in the United States is a process where individuals already present in the U.S. can proactively apply for asylum with U.S. Citizenship and Immigration Services (USCIS). Individuals seeking asylum in the United States must also file their asylum application within one year of their last entry. This one-year filing deadline is a crucial requirement for asylum eligibility. However, if an individual misses the one-year filing deadline, they may still be eligible to apply for asylum if they can demonstrate certain exceptional circumstances that prevented them from filing within the one-year timeframe. Upon submission of the asylum application, USCIS arranges a biometrics appointment for you, during which your fingerprints, photographs, and signatures are collected for background checks. Following the submission of the affirmative asylum application (Form I-589) there is a waiting period of 150 days. After this period, we can assist you in filing Form I-765 with USCIS to request work authorization. Subsequently, USCIS schedules an interview with the asylum applicant to assess their eligibility.
